Understanding Employment Rights and Medical Marijuana: Can Your Employer Fire You for Testing Positive?

Since Oklahoma legalized medical marijuana, one question has landed on employment lawyers' desks more than almost any other: can an employer fire — or refuse to hire — someone who tests positive for marijuana if that person holds a valid medical marijuana license?

The General Rule

In Oklahoma, an employer is generally prohibited from refusing to hire, disciplining, discharging, or otherwise penalizing an applicant or employee solely on the basis of a positive test for marijuana components or metabolites if the individual is in possession of a valid medical marijuana license.

In other words: the license matters. A lawful patient generally cannot be punished merely for a positive test result.

The Exceptions

The protections are real, but so are the limits. Employers retain the right to act in several important situations:

  • Use or possession at work. An employer may take action if the patient uses or possesses marijuana in the workplace or during work hours. The law protects patient status — not on-the-job impairment.
  • Safety-sensitive positions. Employers can refuse employment or discipline workers in safety-sensitive roles, such as handling hazardous materials, operating machinery, or providing direct patient or child care.
  • Federal conflicts. Employers retain protections when failing to act would cause the employer to lose a monetary or licensing-related benefit under federal law or regulations — a common issue for federal contractors and regulated industries.

What This Means for Employers and Employees

For employers, the safest course is a clear, consistently applied drug and alcohol policy that correctly identifies safety-sensitive positions and reflects the current state of Oklahoma law. For employees, understanding the boundaries of the protection — especially around workplace use and safety-sensitive designations — is essential before assuming a license settles the matter.
